PrimeCROWD is expanding

As a partner of Austria’s largest start-up investor network, we are pleased to announce that primeCROWD opened an office in Munich’s Prinzregentenstrasse in February 2019. The German start-up ecosystem holds new, untapped potential in the areas of FinTech, CleanTech, HealthTech as well as IT and software. We are convinced that primeCROWD will be able to continue its previous successes in Austria also in the German market.

Nuclear fission in a different way – and h-i-p takes part

The aws First Pitch Night took place on November 28, 2018: ten start-up teams presented their developments; the race was won by the start-up Kern-tec. Kern-tec has developed an innovative method to split stone fruit kernels and was rewarded with a 500 € voucher from h-i-p for their victory.

We also took part in the run-up to the event: Dr. Michael Zwirchmayr provided a workshop for the start-up teams in which they were given all relevant information on company formation, tax law and data protection. We congratulate Kern-Tec on their victory and look forward to welcoming them to our office for legal advice soon!

Review: This was the Oktoberfest for start-up enthusiasts

On October 11, 2018 we organized our Oktoberfest in the Bohemian Prater, together with primeCROWD and ECOVIS.

Moderated by Florian Kandler, there was an exciting program with guild music by Sumawind, a special guest, startup pitches and “bullriding“.

After a unique talk by Gerald Hörhan, the investment punk, and two pitches by our newest start-ups, the evening has found its undisputed highlight in the “Bull Riding Contest“. Markus Kainz, CEO of primeCROWD, made a great start. We hereby salute all brave participants for their courageous commitment to the bull.

Deepsearch has introduced its artificial intelligence, which optimizes the efficiency of customer contacts in large companies. Urban Food & Beverage helps F&B start-ups to gain a foothold in the Austrian retail sector and presented its business model.

We thank all guests for the full house and for joining the party.

Of course, we also took pictures of the evening.

Obligation to report to KommAustria: What YouTubers should do now

At the beginning of September, the Austrian Communications Authority (KommAustria) sent information letters to several owners of Austrian YouTube channels, drawing their attention to the legal obligation to report the start of operations of a so-called audio-visual media service. According to the Audiovisual Media Services Act (AMD-G), providers of on-demand media services (on-demand service providers) must notify KommAustria of their activities at least two weeks before KommAustria becomes the competent authority.

The media echo that followed revealed uncertainty among some YouTubers. Trending Topics has already reported on this matter. What is behind this information from KommAustria? Do YouTubers actually have to report their channel to the authorities and otherwise face high penalties? And do YouTubers have to pay fees for their online presence?

Hooray! Our DSGVO Online-Tool is here!

DSGVO: Data protection tool for creating a directory of processing activities – datenschutz-recht.at

The General Data Protection Regulation (DSGVO) will be directly applicable throughout the territory of the Union from May 25, 2018 and will entail numerous changes. By that date, all companies must have prepared the necessary documents in order to fulfill their obligations from the new legal situation. Otherwise there is a risk of sensitive fines: The fine from the old legal situation will be raised from up to EUR 25,000.00 to up to EUR 20 million or 4% of the worldwide annual turnover.

What is this all about?

The DSGVO stipulates that within the framework of your company you must document the purpose for which you process personal data. In order to fulfill this documentation obligation, you must (as the central document) compile a list of your processing activities (one processing activity is the processing of personal data for a certain purpose). To fulfill this obligation, we have created afree data protection tool which you can use to create the directory yourself in a simple and clear manner. The given fields only have to be filled out with the declarations provided. This way you can document each data application in detail and then download it as a clear document.

The online tool also has a large collection of definitions, which explain possible ambiguities.

If you choose the (chargeable) premium version(EUR 144,00 per year including VAT), you can not only

  • have access to a large number of ready-made templates, but also have the opportunity to
  • access to constantly updated drafts for contracts as well as sample texts and fill-in aids

Further information can be found at: https://datenschutz-recht.at

As a premium user, you will also receive regular information in case of any changes in the legal situation.

P.S.: For associations we have developed our own data protection tool at https://vereine.datenschutz-recht.at, which is tailored to the needs of associations and contains those data applications as templates that associations usually need.
